Member St= ates are required to comply with the Charter when implementing Community law. Si= nce the European Scrutiny Committee (ESC) has proved and concluded that there w= as an insufficient achievement of a ‘red line’ on the Charter, this Charter will have application with significant implications within the <st1= :country-region w:st=3D"on"><st1:place w:st=3D"on">UK</st1:place></st1:country-region>. <o:= p></o:p> <o:p> </o:p> The Charter will be directly and legally binding = for the European institutions, and Member States when implementing Union law. O= bviously, Member States are obliged to ensure that in all areas of activity, to ensure that the “fundamental rights” are respected. The Member States = will have an onus upon them to respect fundamental rights when legislating and implementing their respective national policies. <o:p></o:p> <o:p> </o:p> The European Court of Justice (ECJ) will have jurisdiction to hear actions brought by the Commission against a <st1:place w:st=3D"on"><st1:PlaceName w:st=3D"on">Member</st1:PlaceName> <st1:PlaceTyp= e w:st=3D"on">State</st1:PlaceType></st1:place> for infringing the Charter when implementing Community law. Moreover, they say "the Charter provides no greater rights t= han are already provided for in <st1:country-region w:st=3D"on">UK</st1:country= -region> law, and that nothing in the Charter extends the ability of any court to st= rike down <st1:country-region w:st=3D"on"><st1:place w:st=3D"on">UK</st1:place><= /st1:country-region> law". However, the preamble to the Protocol stressed “… th= at this Protocol is without prejudice to other obligations devolving upon Pola= nd and the United Kingdom under the Treaty on European Union, the Treaty on the Functioning of the European Union, and Union law generally.” Hence, t= he Protocol will not prevent the Courts of England, <st1:country-region w:st= =3D"on">Wales</st1:country-region>, <st1:country-region w:st=3D"on">Scotland</st1:country-region> and <st1:place w:st=3D"on"><st1:country-region w:st=3D"on">Northern Ireland</st1:country-r= egion></st1:place> from being bound by the ECJ interpretations of Union law measures based upon the Charter. <o:p></o:p> <o:p> </o:p> Under Article 3a of the Lisbon Treaty and to ensu= re the uniform application of the Union law in the respective Member States, t= he national courts are compelled to follow an ECJ ruling when interpreting a measure of Union law in a case arising in another <st1:place w:st=3D"on"><st1:PlaceName w:st=3D"on">Member</st1:PlaceName> <st1:PlaceType w:st=3D"on">State</st1:P= laceType></st1:place>. According to the ESC, “the only way of ensuring that the Charter does= not affect <st1:country-region w:st=3D"on"><st1:place w:st=3D"on">UK</st1:place= ></st1:country-region> law in any way is to make clear, … that the Protocol takes effect “notwithstanding the Treaties or Union Law in general.” <o:p></= o:p> <o:p> </o:p> According to the Lisbon Treaty, “The Union shall accede to the European Convention for the Protection of Human Rights = and Fundamental Freedoms” while, presently, the TEU does not provide for = accession. According to the ECJ opinion 2/94, the EU lacked competence to become party= to the ECHR. Taking into account that the accession to the ECHR is restricted to t= he Council of Europe Member States’, this is another clear example of the Union trying to act with the political powers of a state. Obviously, this w= ill entitle the <st1:place w:st=3D"on">Union</st1:place> to bring Member States before the European Court of Human Rights.
