It claims that in = its relations with the wider world, the <st1:place w:st=3D"on">Union</st1:place> shall uphold “the protection of human rights”, based upon its n= ew provisions for human rights. Since that will include the Charter and the provisions of this Treaty, this must be stopped. Given that under the terms= of <st1:City w:st=3D"on">Lisbon</st1:City>, the EU will begin to forcefully represent th= e <st1:place w:st=3D"on"><st1:country-region w:st=3D"on">UK</st1:country-region></st1:pl= ace>’s interest beyond the European Union and into the wider w= orld, its intention is to actively use the provisions of the Lisbon Treaty as external benchmarks for external action. Again, the UK Government will have surrendered its decision-making over the necessity for human rights benchma= rks it should have set for future diplomacy, trade and cultural relations with non-EU countries. The <st1:country-region w:st=3D"on"><st1:place w:st=3D"on= ">UK</st1:place></st1:country-region> is sacrificing such important diplomatic, economic, trade and cultural relations whilst it continues to respect the protection of an oppressive European rights doctrine. <sp= an style=3D'mso-spacerun:yes'> <o:p><= /o:p> <o:p>&= nbsp;</o:p> <p class=3DMsoNormal style=3D'margin-left:18.0pt;text-align:justify;text-in= dent: -18.0pt;mso-list:l0 level1 lfo1;tab-stops:list 18.0pt;border:none;mso-borde= r-alt: solid windowtext .5pt;padding:0cm;mso-padding-alt:1.0pt 4.0pt 1.0pt 4.0pt'>= <![if !supportLists]>· <![endif]>The Treaty makes claims to promoting peace. Article 2, in pa= rticular, establishes as a Union objective, the goal of peace. The aim of promoting p= eace across the globe (and not just in Europe) is something which has been set a= side for the UN and NATO, in which <st1:country-region w:st=3D"on"><st1:place w:= st=3D"on">Britain</st1:place></st1:country-region> already plays a major role. What right does the EU have to assert this with= in an EU Treaty? <o:p></o:p> <o:p>&= nbsp;</o:p> <p class=3DMsoNormal style=3D'margin-left:18.0pt;text-align:justify;text-in= dent: -18.0pt;mso-list:l0 level1 lfo1;tab-stops:list 18.0pt;border:none;mso-borde= r-alt: solid windowtext .5pt;padding:0cm;mso-padding-alt:1.0pt 4.0pt 1.0pt 4.0pt'>= <![if !supportLists]>· <![endif]>The Treaty makes claims to respecting = the border controls of nation-states. Contrary to the Article, the <st1:pla= ce w:st=3D"on">Union</st1:place> does not respect Member States’ borders control and is thus, moving forward towards a common asylum and immigration policy. With the 1998 Amsterdam Treaty, visas, asylum, immigration and other policies related to free movement of persons were transferred from the intergovernmental to the EC pillar becoming subjected to majority voting and the scrutiny of the European Court of Justice. Furthermore, under the Immigration Regulations 2006 which transposed the provisions of the Directi= ve 2004/38/EC into <st1:country-region w:st=3D"on">UK</st1:country-region> dom= estic legislation, all citizens of the European Economic Area (EEA) acquired the right to come and live in the <st1:place w:st=3D"on"><st1:country-region w:= st=3D"on">UK</st1:country-region></st1:place> with their families. Member S= tates should be able to keep their sovereign right to control their borders yet s= uch right seems to be even more remote as we move toward a common migration and asylum policy within the Lisbon Treaty. <o:p><= /o:p> <o:p>&= nbsp;</o:p> <p class=3DMsoNormal style=3D'margin-left:18.0pt;text-align:justify;text-in= dent: -18.0pt;mso-list:l0 level1 lfo1;tab-stops:list 18.0pt;border:none;mso-borde= r-alt: solid windowtext .5pt;padding:0cm;mso-padding-alt:1.0pt 4.0pt 1.0pt 4.0pt'>= <![if !supportLists]>· <![endif]>The Treaty promotes the internal = market as a top priority. It commits itself to such provisions even in face of the picture that such market provisions do not work in the new globalised economy. Protectionism, which is an inherent principle of <st1:place w:st= =3D"on">Europe</st1:place>’s regional trading bloc, is still rife. A “social market economy” equals low growth and high unemployment. Europe is not even near to achievi= ng full employment, and its objectives set as part of the <st1:place w:st=3D"o= n"><st1:City w:st=3D"on">Lisbon</st1:City></st1:place> strategy for growth and job-crea= tion have clearly failed. <o:p></o:p> <o:p>&= nbsp;</o:p> <p class=3DMsoNormal style=3D'margin-left:18.0pt;text-align:justify;text-in= dent: -18.0pt;mso-list:l0 level1 lfo1;tab-stops:list 18.0pt;border:none;mso-borde= r-alt: solid windowtext .5pt;padding:0cm;mso-padding-alt:1.0pt 4.0pt 1.0pt 4.0pt'>= <![if !supportLists]>· <![endif]>The Treaty attempts to lay down provisions for the protection of t= he environment. However, <st1:place w:st=3D"on">Europe</st1:place>’s objective for the protection of the environment is simply not working, and there are many cases in which this has been established – for instanc= e, the EU Emission Trading Schemes are not reducing but increasing CO2 emissio= ns. <o:p></o:p> <o:p>&= nbsp;</o:p> </div> <div style=3D'mso-element:para-border-div;border:solid windowtext 1.0pt; mso-border-alt:solid windowtext .5pt;padding:1.0pt 4.0pt 1.0pt 3.0pt'> <p class=3DMsoNormal style=3D'margin-left:18.0pt;text-align:justify;text-in= dent: -18.0pt;mso-list:l0 level1 lfo1;tab-stops:list 18.0pt;border:none;mso-borde= r-alt: solid windowtext .5pt;padding:0cm;mso-padding-alt:1.0pt 4.0pt 1.0pt 3.0pt'>= <![if !supportLists]>· <![endif]>The Union must simply not take it upon itself to combat social exclu= sion and promotion of social justice, since this is a <st1:place w:st=3D"on"= ><st1:PlaceName w:st=3D"on">Member</st1:PlaceName> <st1:PlaceType w:st=3D"on">State</st1:P= laceType></st1:place> responsibility. Not only does it differ between states as to what “so= cial justice” is, but this assumes that ultimate control over justice and = home affairs legislation is possible. <st1:place w:st=3D"on"><st1:country-region w:st=3D"on">Britain</st1:country-region></st1:place> already has an organi= sed programme for defining and managing social exclusion. <o:p></o:p> <o:p>&= nbsp;</o:p> <p class=3DMsoNormal style=3D'margin-left:18.0pt;text-align:justify;text-in= dent: -18.0pt;mso-list:l0 level1 lfo1;tab-stops:list 18.0pt;border:none;mso-borde= r-alt: solid windowtext .5pt;padding:0cm;mso-padding-alt:1.0pt 4.0pt 1.0pt 3.0pt'>= <![if !supportLists]>· <![endif]>The Union’s promotion of “economic, social and territorial cohesion and solidarity among Member States” is an effective way of increasing <st1:place w:st=3D"on"><st1= :PlaceName w:st=3D"on">Member</st1:PlaceName> <st1:PlaceType w:st=3D"on">State</st1:P= laceType></st1:place> dependence on massive structural f= unds. It has committed itself to this principle when it is abundantly clear that a subsidised Europe is now a failed <st1:place w:st=3D"on">Europe</st1:place>= . <o:p></o:p> <o:p> </o:p> <p class=3DMsoNormal style=3D'margin-left:18.0pt;text-align:justify;text-in= dent: -18.0pt;mso-list:l0 level1 lfo1;tab-stops:list 18.0pt;border:none;mso-borde= r-alt: solid windowtext .5pt;padding:0cm;mso-padding-alt:1.0pt 4.0pt 1.0pt 3.0pt'>= <![if !supportLists]>· <![endif]>Whilst, under current arrangements, it remains within the power of the <st1:country= -region w:st=3D"on"><st1:place w:st=3D"on">UK</st1:place></st1:country-region> to r= epeal or amend aspects of the acquis, it is unlik= ely that this power would survive the Reform Treaty’s enhanced measure to “build on” the acquis communautaire. Of course, this will strangle the lifeline of British business and indeed European business – with EU regulations currently costing €600 billion per year according to one Industry Commissioner – if there is not a clause within the parliamentary Bill expressly reaffirming the sovereignty of Parliament. <o:p><= /o:p> <o:p>&= nbsp;</o:p> <p class=3DMsoNormal style=3D'margin-left:18.0pt;text-align:justify;text-in= dent: -18.0pt;mso-list:l0 level1 lfo1;tab-stops:list 18.0pt;border:none;mso-borde= r-alt: solid windowtext .5pt;padding:0cm;mso-padding-alt:1.0pt 4.0pt 1.0pt 3.0pt'>= <![if !supportLists]>· <![endif]>The Union has not respected each= <st1:place w:st=3D"on"><st1:PlaceName w:st=3D"on">Member</st1:PlaceName> <st1:PlaceTyp= e w:st=3D"on">State</st1:PlaceType></st1:place>’s cultural diversity and any ass= ertion in the Treaty must be taken as a token of excessive European cultural assimilation. <o:p></o:p> <o:p>&= nbsp;</o:p> <p class=3DMsoNormal style=3D'margin-left:18.0pt;text-align:justify;text-in= dent: -18.0pt;mso-list:l0 level1 lfo1;tab-stops:list 18.0pt;border:none;mso-borde= r-alt: solid windowtext .5pt;padding:0cm;mso-padding-alt:1.0pt 4.0pt 1.0pt 3.0pt'>= <![if !supportLists]>· <![endif]>Paragraph 4 again strengthens the = euro as the EU’s currency. It implies that <st= 1:place w:st=3D"on"><st1:country-region w:st=3D"on">UK</st1:country-region></st1:pl= ace> should adopt the euro. <o:p></o:p> <o:p>&= nbsp;</o:p> <p class=3DMsoNormal style=3D'margin-left:18.0pt;text-align:justify;text-in= dent: -18.0pt;mso-list:l0 level1 lfo1;tab-stops:list 18.0pt;border:none;mso-borde= r-alt: solid windowtext .5pt;padding:0cm;mso-padding-alt:1.0pt 4.0pt 1.0pt 3.0pt'>= <![if !supportLists]>· <![endif]>Paragraph 5 refers to the <st1:p= lace w:st=3D"on">Union</st1:place>’s relations with the “wider world.” It has not yet realised that it is not the <st1:place w:st=3D= "on">Union</st1:place>’s job to create and supervise peace = and security across the globe but NATO and the UN. <o:p></o:p> <o:p>&= nbsp;</o:p> <p class=3DMsoNormal style=3D'margin-left:18.0pt;text-align:justify;text-in= dent: -18.0pt;mso-list:l0 level1 lfo1;tab-stops:list 18.0pt;border:none;mso-borde= r-alt: solid windowtext .5pt;padding:0cm;mso-padding-alt:1.0pt 4.0pt 1.0pt 3.0pt'>= <![if !supportLists]>· <![endif]>The Treaty will not enable the <= st1:place w:st=3D"on">Union</st1:place> to contribute towards “free and fair trade.” In fact, <st1:City w:st=3D"o= n"><st1:place w:st=3D"on">Doha</st1:place></st1:City> is a good example of where EU protectionist trade is jeopardising both the developed global trading struc= ture and the developing world. <o:p></o:p> <o:p>&= nbsp;</o:p> <p class=3DMsoNormal style=3D'margin-left:18.0pt;text-align:justify;text-in= dent: -18.0pt;mso-list:l0 level1 lfo1;tab-stops:list 18.0pt;border:none;mso-borde= r-alt: solid windowtext .5pt;padding:0cm;mso-padding-alt:1.0pt 4.0pt 1.0pt 3.0pt'>= <![if !supportLists]>· <![endif]>Many of the new objectives are already provided in Article 2 TEU, Article 2 and 3 TEC as well as in various Articles of the TEC but most astonishing of all is</spa= n> that there is no mention as to whether the <st1:place w:st=3D"on">Union</st= 1:place>’s objective is free and undistorted competition. Since it is such an essential feature of the Internal Mark= et, it must be noted that the French President (Sarkozy</span= >) was able to negotiate the removal of free and undistorted competition from the Treaty, which represents a real threat to free competition. The reference to undistorted competition was moved to the Protocol on the Internal Market an= d Competition, annexed to the Treaties. This section of the Treaty makes no effective lega= lly binding statement that would be able to defend the objective of free and undistorted competition. <o:p></o:p> <o:p>&= nbsp;</o:p> <p class=3DMsoNormal style=3D'margin-left:18.0pt;text-align:justify;text-in= dent: -18.0pt;mso-list:l0 level1 lfo1;tab-stops:list 18.0pt;border:none;mso-borde= r-alt: solid windowtext .5pt;padding:0cm;mso-padding-alt:1.0pt 4.0pt 1.0pt 3.0pt'>= <![if !supportLists]>· <![endif]>The provision states that “= ;The Union shall pursue its objectives by appropriate means commensurate with the competences which are conferred upon it in the Treaties.” It is well = know that in relation to shared competences, the principle of subsidiarity does not work. Moreover, if ther= e is not a specific legal base for some of the Community’s objectives,</sp= an> </spa= n>Article 308 of the EC Treaty s= tates that: “If action by the Community should prove necessary to attain, in the course of the </spa= n>ope= ration of the common market, one of the objectives of the Community, and this Treaty has not provided the necessary powers, the Council shall, acting unanimously on a proposal from the Commission and after consulting the Europ= ean Parliament, take the appropriate measures.” This Article will continu= e to be used and abused – under the Reform Treaty’s enhanced measures for gaining shared competencies – by the Commission as the legal base for measures which h= ave no connection with the operation of the common market. The <st1:place w:st= =3D"on">Union</st1:place> has for far too long been extending its competences ignoring the Member Sta= tes competences and interests. <o:p></o:p> </div> <o:p>&= nbsp;</o:p> </div> </body> </html>

It claims that in = its relations with the wider world, the <st1:place w:st=3D"on">Union</st1:place> shall uphold “the protection of human rights”, based upon its n= ew provisions for human rights. Since that will include the Charter and the provisions of this Treaty, this must be stopped. Given that under the terms= of <st1:City w:st=3D"on">Lisbon</st1:City>, the EU will begin to forcefully represent th= e <st1:place w:st=3D"on"><st1:country-region w:st=3D"on">UK</st1:country-region></st1:pl= ace>’s interest beyond the European Union and into the wider w= orld, its intention is to actively use the provisions of the Lisbon Treaty as external benchmarks for external action. Again, the UK Government will have surrendered its decision-making over the necessity for human rights benchma= rks it should have set for future diplomacy, trade and cultural relations with non-EU countries. The <st1:country-region w:st=3D"on"><st1:place w:st=3D"on= ">UK</st1:place></st1:country-region> is sacrificing such important diplomatic, economic, trade and cultural relations whilst it continues to respect the protection of an oppressive European rights doctrine. <sp= an style=3D'mso-spacerun:yes'> <o:p><= /o:p> <o:p>&= nbsp;</o:p> <p class=3DMsoNormal style=3D'margin-left:18.0pt;text-align:justify;text-in= dent: -18.0pt;mso-list:l0 level1 lfo1;tab-stops:list 18.0pt;border:none;mso-borde= r-alt: solid windowtext .5pt;padding:0cm;mso-padding-alt:1.0pt 4.0pt 1.0pt 4.0pt'>= <![if !supportLists]>· <![endif]>The Treaty makes claims to promoting peace. Article 2, in pa= rticular, establishes as a Union objective, the goal of peace. The aim of promoting p= eace across the globe (and not just in Europe) is something which has been set a= side for the UN and NATO, in which <st1:country-region w:st=3D"on"><st1:place w:= st=3D"on">Britain</st1:place></st1:country-region> already plays a major role. What right does the EU have to assert this with= in an EU Treaty? <o:p></o:p> <o:p>&= nbsp;</o:p> <p class=3DMsoNormal style=3D'margin-left:18.0pt;text-align:justify;text-in= dent: -18.0pt;mso-list:l0 level1 lfo1;tab-stops:list 18.0pt;border:none;mso-borde= r-alt: solid windowtext .5pt;padding:0cm;mso-padding-alt:1.0pt 4.0pt 1.0pt 4.0pt'>= <![if !supportLists]>· <![endif]>The Treaty makes claims to respecting = the border controls of nation-states. Contrary to the Article, the <st1:pla= ce w:st=3D"on">Union</st1:place> does not respect Member States’ borders control and is thus, moving forward towards a common asylum and immigration policy. With the 1998 Amsterdam Treaty, visas, asylum, immigration and other policies related to free movement of persons were transferred from the intergovernmental to the EC pillar becoming subjected to majority voting and the scrutiny of the European Court of Justice. Furthermore, under the Immigration Regulations 2006 which transposed the provisions of the Directi= ve 2004/38/EC into <st1:country-region w:st=3D"on">UK</st1:country-region> dom= estic legislation, all citizens of the European Economic Area (EEA) acquired the right to come and live in the <st1:place w:st=3D"on"><st1:country-region w:= st=3D"on">UK</st1:country-region></st1:place> with their families. Member S= tates should be able to keep their sovereign right to control their borders yet s= uch right seems to be even more remote as we move toward a common migration and asylum policy within the Lisbon Treaty. <o:p><= /o:p> <o:p>&= nbsp;</o:p> <p class=3DMsoNormal style=3D'margin-left:18.0pt;text-align:justify;text-in= dent: -18.0pt;mso-list:l0 level1 lfo1;tab-stops:list 18.0pt;border:none;mso-borde= r-alt: solid windowtext .5pt;padding:0cm;mso-padding-alt:1.0pt 4.0pt 1.0pt 4.0pt'>= <![if !supportLists]>· <![endif]>The Treaty promotes the internal = market as a top priority. It commits itself to such provisions even in face of the picture that such market provisions do not work in the new globalised economy. Protectionism, which is an inherent principle of <st1:place w:st= =3D"on">Europe</st1:place>’s regional trading bloc, is still rife. A “social market economy” equals low growth and high unemployment. Europe is not even near to achievi= ng full employment, and its objectives set as part of the <st1:place w:st=3D"o= n"><st1:City w:st=3D"on">Lisbon</st1:City></st1:place> strategy for growth and job-crea= tion have clearly failed. <o:p></o:p> <o:p>&= nbsp;</o:p> <p class=3DMsoNormal style=3D'margin-left:18.0pt;text-align:justify;text-in= dent: -18.0pt;mso-list:l0 level1 lfo1;tab-stops:list 18.0pt;border:none;mso-borde= r-alt: solid windowtext .5pt;padding:0cm;mso-padding-alt:1.0pt 4.0pt 1.0pt 4.0pt'>= <![if !supportLists]>· <![endif]>The Treaty attempts to lay down provisions for the protection of t= he environment. However, <st1:place w:st=3D"on">Europe</st1:place>’s objective for the protection of the environment is simply not working, and there are many cases in which this has been established – for instanc= e, the EU Emission Trading Schemes are not reducing but increasing CO2 emissio= ns. <o:p></o:p> <o:p>&= nbsp;</o:p> </div> <div style=3D'mso-element:para-border-div;border:solid windowtext 1.0pt; mso-border-alt:solid windowtext .5pt;padding:1.0pt 4.0pt 1.0pt 3.0pt'> <p class=3DMsoNormal style=3D'margin-left:18.0pt;text-align:justify;text-in= dent: -18.0pt;mso-list:l0 level1 lfo1;tab-stops:list 18.0pt;border:none;mso-borde= r-alt: solid windowtext .5pt;padding:0cm;mso-padding-alt:1.0pt 4.0pt 1.0pt 3.0pt'>= <![if !supportLists]>· <![endif]>The Union must simply not take it upon itself to combat social exclu= sion and promotion of social justice, since this is a <st1:place w:st=3D"on"= ><st1:PlaceName w:st=3D"on">Member</st1:PlaceName> <st1:PlaceType w:st=3D"on">State</st1:P= laceType></st1:place> responsibility. Not only does it differ between states as to what “so= cial justice” is, but this assumes that ultimate control over justice and = home affairs legislation is possible. <st1:place w:st=3D"on"><st1:country-region w:st=3D"on">Britain</st1:country-region></st1:place> already has an organi= sed programme for defining and managing social exclusion. <o:p></o:p> <o:p>&= nbsp;</o:p> <p class=3DMsoNormal style=3D'margin-left:18.0pt;text-align:justify;text-in= dent: -18.0pt;mso-list:l0 level1 lfo1;tab-stops:list 18.0pt;border:none;mso-borde= r-alt: solid windowtext .5pt;padding:0cm;mso-padding-alt:1.0pt 4.0pt 1.0pt 3.0pt'>= <![if !supportLists]>· <![endif]>The Union’s promotion of “economic, social and territorial cohesion and solidarity among Member States” is an effective way of increasing <st1:place w:st=3D"on"><st1= :PlaceName w:st=3D"on">Member</st1:PlaceName> <st1:PlaceType w:st=3D"on">State</st1:P= laceType></st1:place> dependence on massive structural f= unds. It has committed itself to this principle when it is abundantly clear that a subsidised Europe is now a failed <st1:place w:st=3D"on">Europe</st1:place>= . <o:p></o:p> <o:p> </o:p> <p class=3DMsoNormal style=3D'margin-left:18.0pt;text-align:justify;text-in= dent: -18.0pt;mso-list:l0 level1 lfo1;tab-stops:list 18.0pt;border:none;mso-borde= r-alt: solid windowtext .5pt;padding:0cm;mso-padding-alt:1.0pt 4.0pt 1.0pt 3.0pt'>= <![if !supportLists]>· <![endif]>Whilst, under current arrangements, it remains within the power of the <st1:country= -region w:st=3D"on"><st1:place w:st=3D"on">UK</st1:place></st1:country-region> to r= epeal or amend aspects of the acquis, it is unlik= ely that this power would survive the Reform Treaty’s enhanced measure to “build on” the acquis communautaire. Of course, this will strangle the lifeline of British business and indeed European business – with EU regulations currently costing €600 billion per year according to one Industry Commissioner – if there is not a clause within the parliamentary Bill expressly reaffirming the sovereignty of Parliament. <o:p><= /o:p> <o:p>&= nbsp;</o:p> <p class=3DMsoNormal style=3D'margin-left:18.0pt;text-align:justify;text-in= dent: -18.0pt;mso-list:l0 level1 lfo1;tab-stops:list 18.0pt;border:none;mso-borde= r-alt: solid windowtext .5pt;padding:0cm;mso-padding-alt:1.0pt 4.0pt 1.0pt 3.0pt'>= <![if !supportLists]>· <![endif]>The Union has not respected each= <st1:place w:st=3D"on"><st1:PlaceName w:st=3D"on">Member</st1:PlaceName> <st1:PlaceTyp= e w:st=3D"on">State</st1:PlaceType></st1:place>’s cultural diversity and any ass= ertion in the Treaty must be taken as a token of excessive European cultural assimilation. <o:p></o:p> <o:p>&= nbsp;</o:p> <p class=3DMsoNormal style=3D'margin-left:18.0pt;text-align:justify;text-in= dent: -18.0pt;mso-list:l0 level1 lfo1;tab-stops:list 18.0pt;border:none;mso-borde= r-alt: solid windowtext .5pt;padding:0cm;mso-padding-alt:1.0pt 4.0pt 1.0pt 3.0pt'>= <![if !supportLists]>· <![endif]>Paragraph 4 again strengthens the = euro as the EU’s currency. It implies that <st= 1:place w:st=3D"on"><st1:country-region w:st=3D"on">UK</st1:country-region></st1:pl= ace> should adopt the euro. <o:p></o:p> <o:p>&= nbsp;</o:p> <p class=3DMsoNormal style=3D'margin-left:18.0pt;text-align:justify;text-in= dent: -18.0pt;mso-list:l0 level1 lfo1;tab-stops:list 18.0pt;border:none;mso-borde= r-alt: solid windowtext .5pt;padding:0cm;mso-padding-alt:1.0pt 4.0pt 1.0pt 3.0pt'>= <![if !supportLists]>· <![endif]>Paragraph 5 refers to the <st1:p= lace w:st=3D"on">Union</st1:place>’s relations with the “wider world.” It has not yet realised that it is not the <st1:place w:st=3D= "on">Union</st1:place>’s job to create and supervise peace = and security across the globe but NATO and the UN. <o:p></o:p> <o:p>&= nbsp;</o:p> <p class=3DMsoNormal style=3D'margin-left:18.0pt;text-align:justify;text-in= dent: -18.0pt;mso-list:l0 level1 lfo1;tab-stops:list 18.0pt;border:none;mso-borde= r-alt: solid windowtext .5pt;padding:0cm;mso-padding-alt:1.0pt 4.0pt 1.0pt 3.0pt'>= <![if !supportLists]>· <![endif]>The Treaty will not enable the <= st1:place w:st=3D"on">Union</st1:place> to contribute towards “free and fair trade.” In fact, <st1:City w:st=3D"o= n"><st1:place w:st=3D"on">Doha</st1:place></st1:City> is a good example of where EU protectionist trade is jeopardising both the developed global trading struc= ture and the developing world. <o:p></o:p> <o:p>&= nbsp;</o:p> <p class=3DMsoNormal style=3D'margin-left:18.0pt;text-align:justify;text-in= dent: -18.0pt;mso-list:l0 level1 lfo1;tab-stops:list 18.0pt;border:none;mso-borde= r-alt: solid windowtext .5pt;padding:0cm;mso-padding-alt:1.0pt 4.0pt 1.0pt 3.0pt'>= <![if !supportLists]>· <![endif]>Many of the new objectives are already provided in Article 2 TEU, Article 2 and 3 TEC as well as in various Articles of the TEC but most astonishing of all is</spa= n> that there is no mention as to whether the <st1:place w:st=3D"on">Union</st= 1:place>’s objective is free and undistorted competition. Since it is such an essential feature of the Internal Mark= et, it must be noted that the French President (Sarkozy</span= >) was able to negotiate the removal of free and undistorted competition from the Treaty, which represents a real threat to free competition. The reference to undistorted competition was moved to the Protocol on the Internal Market an= d Competition, annexed to the Treaties. This section of the Treaty makes no effective lega= lly binding statement that would be able to defend the objective of free and undistorted competition. <o:p></o:p> <o:p>&= nbsp;</o:p> <p class=3DMsoNormal style=3D'margin-left:18.0pt;text-align:justify;text-in= dent: -18.0pt;mso-list:l0 level1 lfo1;tab-stops:list 18.0pt;border:none;mso-borde= r-alt: solid windowtext .5pt;padding:0cm;mso-padding-alt:1.0pt 4.0pt 1.0pt 3.0pt'>= <![if !supportLists]>· <![endif]>The provision states that “= ;The Union shall pursue its objectives by appropriate means commensurate with the competences which are conferred upon it in the Treaties.” It is well = know that in relation to shared competences, the principle of subsidiarity does not work. Moreover, if ther= e is not a specific legal base for some of the Community’s objectives,</sp= an> </spa= n>Article 308 of the EC Treaty s= tates that: “If action by the Community should prove necessary to attain, in the course of the </spa= n>ope= ration of the common market, one of the objectives of the Community, and this Treaty has not provided the necessary powers, the Council shall, acting unanimously on a proposal from the Commission and after consulting the Europ= ean Parliament, take the appropriate measures.” This Article will continu= e to be used and abused – under the Reform Treaty’s enhanced measures for gaining shared competencies – by the Commission as the legal base for measures which h= ave no connection with the operation of the common market. The <st1:place w:st= =3D"on">Union</st1:place> has for far too long been extending its competences ignoring the Member Sta= tes competences and interests. <o:p></o:p> </div> <o:p>&= nbsp;</o:p> </div> </body> </html>
