 laws

establishes the EU objectives for strengthening freedom, security and justi=

for the period 2005-2010. The European Commission is confident in ensuring =

development of this policy by making several proposals, some of which has a=

measures&#8221;, the underlying federalist ambitions will mean that it will
lead to stricter control measures than the current Article 63 (3) (b) on th=
e repatriation

measures concerning illegal immigration are decided by QMV at the Council a=

through the co-decision procedure. However legal migration has been governe=

Parliament has a limited role in concerns over legal migration. Under the
Lisbon Treaty, however, all common policy immigration measures will be deci=
ded
together by the European Parliament and the Council through the ordinary
legislative procedure (co-decision procedure) and by QMV in the Council. The
Lisbon Treaty abolishes the veto over legal migration hence the <st1:countr=
y-region
w:st=3D"on"><st1:place w:st=3D"on">UK</st1:place></st1:country-region> will=
 have to

the European Commission has recently proposed a Council Directive on a sing=

ountry

Directive aims to grant socio-economic rights to third country-workers on e=
qual
terms with the Member States own nationals. The proposal&#8217;s main objec=
tive
is to ensure equal treatment to third country workers who reside legally in=
 a <st1:place
w:st=3D"on"><st1:PlaceName w:st=3D"on">Member</st1:PlaceName> <st1:PlaceTyp=
e w:st=3D"on">State</st1:PlaceType></st1:place>.
It is currently being discussed.<span style=3D'mso-bidi-font-style:italic'>
Whereas, under existing conditions, such measures are adopted by unanimity =
in
the Council and through the consultation procedure under the Lisbon Treaty,
they will be adopted by QMV in the Council and through the ordinary legisla=
tive
procedure enhancing the influential role of the European Parliament. The new
Article 63 (2) (b) provides for measures defining </span>&#8220;the rights =
of
third-country nationals residing legally in a Member State, including the
conditions governing freedom of movement and of residence in other Member
States&#8221; which is similar to Article 63 (4) TEC. However, the EU
competences are broader. <o:p></o:p></span></p>

account that the Union common immigration policy aims to ensure &#8220;fair
treatment of third-country nationals residing legally in Member States.&#82=

Moreover, the new clause provides for the adoption of EU legislation defini=
ng
the rights of legally resident third country nationals comprising (but not =
limited
to) &#8220;the conditions governing freedom of movement and of residence in
other Member States.&#8221; The European Commission has also recently propo=
sed
a Council Directive on the conditions of entry and residence of third-count=
ry
nationals for the purposes of highly qualified employment. The Draft Direct=
ive
aims to <span class=3DSpellE>harmonise</span> the admission conditions of e=
ntry
and residence of this category of workers. It also lays down the conditions
under which a third-country national may reside in a second <st1:place w:st=
=3D"on"><st1:PlaceName
 w:st=3D"on">Member</st1:PlaceName> <st1:PlaceType w:st=3D"on">State</st1:P=
laceType></st1:place>.
Such proposals are subject to unanimity in the Council.<span

for a Directive of the European Parliament and of the Council on common
standards and procedures in Member States for returning illegally staying
third-country nationals is currently being discussed. Moreover, the fight
against illegal immigration implies the possibility of criminal sanctions. =

ssion has
also recently presented a proposal for a Directive, providing for common
sanctions and measures against employers of third country nationals who are
illegally staying on the territory of the Member States based on existing
Article 63 (3) (b). The Lisbon Treaty also introduces a new legal base, Art=
icle<span
style=3D'mso-bidi-font-weight:bold'> 63a (2) (d), for measures &#8220;comba=
ting
trafficking in persons, in particular women and children.&#8221; </span><o:=

Treaty provides for a new legal basis [Article 63a(3)] </span><span

countries. This new clause provides that &#8220;The Union may conclude
agreements with third countries for the readmission to their countries of

e in
the territory of one of the Member States.&#8221; The Council has already b=
een <span
class=3DSpellE>authorising</span> the Commission to negotiate readmission
agreements with several third countries under the existing Article 63 (3) (=
b),
concerning measures on illegal immigration and repatriation of illegal
residents. Some of these agreements have already entered into force. They l=
ay
down the obligation to readmit nationals of the country with which the EU h=
ave

forward the boundaries in providing incentives and support for the action of
Member States with the aim to promoting the integration of third-country
nationals within their boundaries. The Commission has been adopting
Communications on integration of third country nationals, such as, for exam=
ple in
September 2005, the Commission adopted the Communication, <i style=3D'mso-b=
idi-font-style:
normal'>A Common Agenda for Integration, Framework for the integration of t=
hird
country nationals in the European Union</i>. The Justice and Home Affairs
Council in </span><span style=3D'font-size:11.0pt;font-family:Arial;mso-far=
east-font-family:
TTA2036168t00;color:black'>June 2007</span><span style=3D'font-size:11.0pt;
font-family:Arial;color:black'> </span><span style=3D'font-size:11.0pt;

conclusions on the strengthening of integration policies in the EU. They
represented a new step in steering the EU integration agenda assessing the =
need
for further action.</span><span style=3D'font-size:11.0pt;font-family:Arial;
color:black'> The Lisbon Treaty introduces a new EU competence in <span
style=3D'mso-bidi-font-weight:bold'>Article 63(a)(4)</span> to &#8220;provi=
de
incentives and support for the action of Member States&#8221; with the aim =
to
&#8220;promote the integration of third-country nationals residing legally =
in
their territories.&#8221; Such incentive and supporting measures for the
integration of third country nationals will be established by the Council
acting by QMV together with the European Parliament through the ordinary
legislative procedure (co-decision procedure). The provision states that
&#8220;any harmonization of the laws and regulations of the Member
States&#8221; is excluded. Nevertheless, it will represent a significant in=
terference
with <st1:place w:st=3D"on"><st1:PlaceName w:st=3D"on">Member</st1:PlaceNam=
e> <st1:PlaceType
 w:st=3D"on">State</st1:PlaceType></st1:place>&#8217;s integration policies.
Moreover, it is probable that &#8220;incentives and support action&#8221; w=
ill be
considered as an open door to <span class=3DSpellE>harmonisation</span>. <o=

al
immigration) shall not prevent any Member State from maintaining or introdu=
cing
in the areas concerned national provisions which are compatible with this
Treaty and with international agreements.&#8221; The Lisbon Treaty, Article=

(5), solely refers to the right of the Member States to &#8220;</span>deter=
mine
the volumes of admission of third country nationals coming from third count=
ries
to their territory in order to seek work, whether employed or self-employed=
.&#8221;
Nevertheless, there is already an </span><span lang=3DEN style=3D'font-size=
:11.0pt;
font-family:Arial;color:black;mso-ansi-language:EN'>access to the <span
class=3DSpellE>labour</span> market by third-country nationals residing in =
a <st1:place
w:st=3D"on"><st1:PlaceName w:st=3D"on">Member</st1:PlaceName> <st1:PlaceTyp=
e w:st=3D"on">State</st1:PlaceType></st1:place>
and such movement will not be prevented. </span><span style=3D'font-size:11=
.0pt;
font-family:Arial;color:black;mso-bidi-font-style:italic'>Therefore, one may
conclude that Member States are not entitled to introduce national measures=
 and
false assurances in this Treaty that national provisions in immigration will
take primacy over EU law are not workable. Even if the right over immigrati=
on is
retained, it will be reduced extensively. The national laws of the respecti=
ve
Member States will be further <span class=3DSpellE>harmonised</span> into a
binding common immigration policy, which is not in <st1:country-region w:st=
=3D"on"><st1:place
 w:st=3D"on">Britain</st1:place></st1:country-region>&#8217;s interest. </s=
