consultation with a special committee appointed by the Council to assist the
Commission in this task and within the framework of such directives as the
Council may issue to it. The Commission shall report regularly to the speci=
al
committee and to the European Parliament on the progress of negotiations.<o=

agreements include provisions for which unanimity is required for the adopt=
ion

cultural and audiovisual services, where these agreements risk prejudicing =

w:st=3D"on">Union</st1:place>'s cultural and linguistic diversity;<o:p></o:=

services and commercial aspects of intellectual property rights. Trade in
services and commercial aspects of intellectual property rights were moved =
from
a separate paragraph Article 133 (5) to Article 188 C (1). Under the Lisbon
Treaty, trade in services and commercial aspects of intellectual property h=
ave
become a genuine part of the <st1:place w:st=3D"on">Union</st1:place>&#8217=
;s
exclusive competence. Moreover, Article 188 C (1) adds a new area to the sc=
ope of
the common commercial policy: foreign direct investment. Hence, the <st1:pl=

w:st=3D"on">Union</st1:place> will have authority to conclude international
investment agreements. Having investment agreements under the scope of the
common commercial policy means that the <st1:place w:st=3D"on">Union</st1:p=

have exclusive competence &#8211; therefore the Member States will lose the=

required where necessary for the adoption of internal rules. Article 188C (=
4)
states &#8220;For the negotiation and conclusion of agreements in the field=
s of
trade in services and the commercial aspects of intellectual property, as w=
ell
as foreign direct investment, the Council shall act unanimously where such
agreements include provisions for which unanimity is required for the adopt=
ion
of internal rules.&#8221; This provision is similar to Article 133 (5) TEC,
however the new provision does not require unanimity where the agreement
&#8220;relates to a field in which the Community has not yet exercised the =
powers
conferred upon it by this Treaty by adopting internal rules&#8221; &#8211;
therefore trade in services and commercial aspects of intellectual property=
 are
definitely part of the Union&#8217;s exclusive competence whether it will
decide to exercise its internal competences in respect of that area or not.=

relating to trade in cultural and audiovisual services, educational service=

and social and human health services are no longer a shared competence of t=
he
Community and the <st1:place w:st=3D"on"><st1:PlaceName w:st=3D"on">Member<=
/st1:PlaceName>
 <st1:PlaceType w:st=3D"on">States</st1:PlaceType></st1:place>. According to
present Article 133 (6), &#8220;An agreement may not be concluded by the
Council if it includes provisions which would go beyond the Community's
internal powers, in particular by leading to <span class=3DSpellE>harmonisa=
tion</span>
of the laws or regulations of the Member States in an area for which this
Treaty rules out such <span class=3DSpellE>harmonisation</span>. In this re=
gard
&#8230; agreements relating to trade in cultural and audiovisual services,
educational services, and social and human health services, shall fall with=
in
the shared competence of the Community and its <st1:place w:st=3D"on"><st1:=
PlaceName
 w:st=3D"on">Member</st1:PlaceName> <st1:PlaceType w:st=3D"on">States</st1:=
PlaceType></st1:place>.
&#8230; <span class=3DGramE>the</span> negotiation of such agreements shall
require the common accord of the Member States. Agreements thus negotiated
shall be concluded jointly by the Community and the <st1:place w:st=3D"on">=
<st1:PlaceName
 w:st=3D"on">Member</st1:PlaceName> <st1:PlaceType w:st=3D"on">States</st1:=
PlaceType></st1:place>.&#8221;
The Article is presented as though under the new provision the agreements
relating to trade in cultural and audiovisual services, educational service=
s,
and social and human health services are no longer a shared competence of t=
he
Community and the <st1:place w:st=3D"on"><st1:PlaceName w:st=3D"on">Member<=
/st1:PlaceName>
 <st1:PlaceType w:st=3D"on">States</st1:PlaceType></st1:place>. Unanimity i=
s still
required but according to Article 188 C (4) &#8220;</span><span
style=3D'font-size:11.0pt;font-family:Arial'>The Council shall also act
unanimously for the negotiation and conclusion of agreements: in the field =
of
trade in cultural and audiovisual services, where these agreements risk pre=
judicing
the Union's cultural and linguistic diversity&#8221; and &#8220;in the fiel=
d of
trade in social, education and health services, where these agreements risk
seriously disturbing the national <span class=3DSpellE>organisation</span> =
of
such services and prejudicing the responsibility of Member States to delive=
r them.&#8221;
However, a <st1:PlaceName w:st=3D"on">Member</st1:PlaceName> <st1:PlaceType
w:st=3D"on">State</st1:PlaceType> will have to provide explanations on how =
the
agreement in question would represent a risk to &#8220;<span style=3D'color=
:black'>the
<st1:place w:st=3D"on">Union</st1:place>&#8217;s cultural and linguistic</s=
pan> <span
style=3D'color:black'>diversity&#8221; or a risk to of disturbing the natio=
nal <span
class=3DSpellE>organisation</span> of social, educational and health servic=
es.
Therefore, if the other Member States do not agree, the Council will act by=
 QMV
and it will be the ECJ which might end up having the last say. <o:p></o:p><=
/span></span></p>

Lisbon Treaty pretends to limit the Union competences in external trade pol=
icy

the Member States, and shall not lead to <span class=3DSpellE>harmonisation=
</span>
of legislative or regulatory provisions of the Member States insofar as the
Treaties exclude such <span class=3DSpellE>harmonisation</span>.&quot; Henc=
e, the
Union will not have the exclusive competence to negotiate or conclude an
international agreement in areas which the <st1:place w:st=3D"on">Union</st=
1:place>

font-family:Arial'>The Lisbon Treaty will enhance the Union position as the
only actor to negotiate and conclude agreements. The scope of the common
commercial policy was massively expanded and therefore it seems that the <s=

w:st=3D"on">Union</st1:place> will be able to negotiate and conclude agreem=
ents
in all aspects covered by the WTO. <span style=3D'color:black'><o:p></o:p><=
/span></span></p>
