OF OVERSEAS COUNTRIES AND TERRITORIES (II)

[ARTICLE 187]

AMENDMENT TO: Treaty of Lisbon amending the Treaty on European Union and t= he Treaty establishing the European Community (Lisbon, 13 December 2007)<= /span>

Lisb= on Treaty Article:

“= ;153) In Article 187, the words "acting unanimously" shall be replaced by "acting unanimousl= y on a proposal from the Commission" and the following sentence shall be ad= ded at the end of the Article: "Where the provisions in question are adopt= ed by the Council in accordance with a special legislative procedure, it shall= act unanimously on a proposal from the Commission and after consulting the Euro= pean Parliament.".”

“Article 187

The Council, acting unanimously, shall, on the basis of the experience acquired under the association of the countries and territories with the Community and of the principles set out in this Treaty, lay down provisions as regards the detai= led rules and the procedure for the association of the countries and territories with the Community.”

Expl= anation: =

The Lisbon Treaty retains the require= ment of unanimity in the Council to “lay down provisions as regards the detailed rules and the procedure for the association of the countries a= nd territories with the Community.” It specifies that the Council shall = act on a proposal from the Commission. Hence, the Commission has a monopoly ove= r making proposals relating to the associated territories. The Lisbon Treaty also in= creases marginally the role of the European Parliament since it shall now be consul= ted. In tandem with Article 186, this Article gives the Commission powers over proposal on the new rules binding the association of the countries = and territories with the Community.
